    Strategic Approach to Litigation

We are prepared to advocate vigorously in court, but our first goal is usually to keep you out of one. Litigation pulls attention away from the business and shows up on the bottom line. When it is unavoidable, here is how we run it:

    Business-Oriented Litigation Strategies

We weigh the return on pursuing a position against what it costs to pursue it (fees, exposure, distraction, and the plain unpredictability of a courtroom). Some clients want to fight on principle. We will tell you honestly that principles are expensive, and then we will fight.

    Holistic Client Focus

Your goals stay the measure of the case from first assessment through final judgment. Because we also serve as outside general counsel, we already know your contracts, your people, and how the dispute started.

    Empty appellate courtroom

Not sure where your situation fits?

    How a Case Actually Moves

    01 Pre-dispute assessment

What the matter is worth, what it will cost to pursue, and whether fighting is the right business decision at all.

    02 Demand and negotiation

Most disputes can still be resolved here, and usually on better terms than they will be later.

    03 Filing

Complaint or answer, with the theory of the case set from day one rather than discovered in month nine.

    04 Discovery

Documents, depositions, and experts. This is where litigation cost is won or lost, so this is where we manage hardest.

    05 Motions and mediation

Narrowing the case, testing it, and taking the settlement when the settlement is the right outcome.

    06 Trial

When trying it is the right call for the business, and we are prepared for that from the first meeting.

    What Litigation Costs

    Hourly, with Partner discounts
Litigation sits outside Partner Plan scope and is billed separately, at discounted rates for active Partner clients.
    Fixed and hybrid options
On smaller matters we can often quote a fixed or hybrid fee rather than run the meter.
    No surprise scope
We identify out-of-scope work before it costs you anything, not after it appears on an invoice.
    FAQ

    Frequently Asked Questions

Do you represent plaintiffs or defendants?

Both. Outside Chief Legal represents business owners, and which side of the caption we appear on depends entirely on how the matter reaches us. Some areas skew defense-side by nature (product liability, professional liability, workers' compensation, and catastrophic injury) while contract, partnership, insurance, and intellectual property disputes come to us from either direction.

What kinds of disputes do you handle?

Seventeen practice areas, spanning commercial and contract disputes, construction, insurance coverage and bad faith, employment, intellectual property, product and professional liability, workers' compensation, premises liability, dram shop, wrongful death, maritime, trucking, data breach, probate and fiduciary matters, and appeals. We do not handle bankruptcy, criminal, or family law.

Will my case go to trial?

Probably not, and that is usually good news. Most business disputes resolve through negotiation, mediation, or arbitration before a trial date arrives. But cases settle on better terms when the other side can see the file is trial-ready, so we build every matter as though it will be tried.

How much does business litigation cost?

It depends on the matter, and any lawyer who quotes a number before seeing the file is guessing. Litigation is billed hourly, at discounted rates for active Partner Plan clients, and we can often quote fixed or hybrid fees on smaller matters. Discovery is the main driver of cost and unpredictability, which is why litigation sits outside our fixed monthly plans.

Can you handle a case outside Alabama?

Our attorneys are licensed in Alabama, Florida, and Mississippi. Beyond that, we identify and retain appropriate counsel in the right jurisdiction, manage the case, and stay accountable for how it progresses, so you are not left vetting and supervising an unfamiliar firm on your own.

Do you serve as local counsel?

Yes. Our attorneys regularly serve as local counsel in Alabama and Northern Florida for in-house legal departments and outside corporate attorneys handling matters here.

What if my dispute is a bankruptcy, criminal, or family law matter?

Those fall outside what we handle. We will find you a vetted attorney who does, make the introduction, and stay involved to help the matter progress, rather than handing over a name and wishing you luck.

Not Sure Which One You Need?

Send us the complaint, the demand letter, or the contract. We will read it before we meet, and you will leave the conversation knowing your options.
